Do not ask.

This is a slight type of repression. I want to be with the trees, go swimming, eat at the resort, but for now; Sheryl Crow music and just blogging. Sadly, I am not completely healed yet. I took the last tablet of my medicine after breakfast but the Doctor advised to take complete rest for seven days. It’s my seventh day today, and I do not think there are things to be hysterically happy. The Bible says seventh day is rest. That however is not applicable to me.

I woke up early and been reading my Criminal Law book. What is really weird about me is everytime I have scheduled exams I always have the libido to do other things. Earlier its somewhat related but out of the context. I have been seriously reading Crimes against Chastity and not the coverage for my special exams. I was just a little frustrated on how some Crimes are being defined and punished. Reality wise, there is really no equality between a man and a woman. Discrimination would always be present in all aspects of life. Even the law of the land does not fail to emanate a hint of prejudice. I am talking about Adultery and Concubinage. For the benefit of those not familiar, I would like to illustrate the elements of these crimes.

Elements of Adultery:

1. That a woman is maried;
2. That she has sexual intercourse with a man not her husband;
3. That as regards the man wth whom she has sexual intercourse, he must know her to be married.

Elements of Concubinage:

1. That the man must be married;
2. That he commited any of the following acts:
a. Keeping a mistress in the conjugal dwelling
b. Having sexual intercourse under scandalous circumstances with a woman who is not his wife;
c. Cohabitating with her in any other place.
3. That as regards the woman, she must know him to be married.

Okay, at the first reading there seems to be nothing wrong with the elements. However, if you try to comprehend each elements you will see that there is a very huge partiality when it comes to the sexuality of the offender. In Adultery, as long as there is sexual intercourse between the woman and a man other than her husband, the woman is automacally punished by the law. The book even states that there is no need for direct proof of carnal knowledge to sustain conviction. A mere photograph showing the intimate relations of the accused and a testimony of a witness to the effect that the two accused were in scant apparel and sleeping together are sufficient evidences. In Concubinage on the other hand, there is a huge opportunity for the accused to escape liability. It is very clear as well that beyond the elements are actually encouragement and a hint to men that it is just okay to be infidel, so long as you do it in such a way that is outside the elements stated. The law indirectly says that it is okay to have discreet sexual relations with other women, as long as you do not bring them to the conjugal dwelling and as long as it is not in scandalous circumstance. Penalty for Adultery is prision correccional in its medium and maximum periods and that means from two years, four months and one day to four years and two months; or four years, two months, and one day to six years whereas in Concubinage, comes with a jail term of prision correccional in its minimum and medium periods and that is from six months and one day to two years and four months, or from two years, four months and one day to four years and two months. The concubine is punished by destierro which only means banning a person from a place, or within its radius of not more than 250 kilometers and not less than 25 kilometers. See the BIG differences?

I remember my favorate professor said not to quarrel with the laws. However, I do not see any valid reason to such distinction. These laws show that men and women are of different standards. It is a clear manifestation of protection of male ego. If you know and understand your stand as a woman and if you are a feminist of your own right, I think you might as well react to this.

Again, I want to be with the trees, go swimming, eat at the resort, but for now; Sheryl Crow music and just blogging.
